We are available to assist clients on permitting, compliance, and enforcement matters, as well as assessment and allocation of environmental liabilities.
Compliance:
Our Firm represents and counsels clients on permits, inspections, spill and release reporting, remediations, and other environmental compliance matters. We have participated in environmental audits and designed environmental management systems and policies.
Beyond Compliance:
Our Firm advises clients on green drilling and completion practices, environmental management systems, and industry benchmarking. We have represented clients in their long-range resource development processes including preparation of a five-year comprehensive drilling plan that obtains government approvals and public consultation up front.
Enforcement Defense:
Our Firm defends clients on alleged permit and regulatory violations including drafting responses to enforcement notices and negotiating fewer violations and less penalties. We have also developed and obtained approval on supplemental environmental projects to reduce penalties. We have achieved expedited close-outs of outstanding environmental enforcement matters in asset sale situations and when client companies desire to show improvement and closure through metrics.
Site Clean-up:
We negotiate and obtain approval for passive and active remedial alternatives; obtain necessary access and land rights for remediation; and settle disputes with affected landowners.
Deals:
Our attorneys have conducted comprehensive environmental due diligence on substantial oil and gas producing assets and pipeline/processing assets in preparation for asset sales including $1.3 and $3.5 billion mergers; negotiated allocations of liability and drafted provisions in numerous purchase and sale agreements; and designed and implemented a unique successful $50 million liability transfer to environmental company backed up by insurance.
Regulatory/Administrative Agency Representation:
Our Firm has counseled and represented clients in rulemakings. We have assumed a leadership role, via frequent presentations to industry, on the evolving technical and regulatory framework controlling hydraulic fracturing.
